The federal government is the largest single purchaser of goods and services in the world, and by law, small businesses are guaranteed the "maximum practicable opportunity" to compete for these contracts. However, as the federal acquisition landscape undergoes significant reform, this guarantee is at great risk.
The "Rule of Two"—the foundational principle that a contract must be set aside for small business if two or more are qualified to perform the work at a reasonable price—is the primary tool for ensuring this access. This rule must be protected from procedural loopholes like unnecessary contract bundling and applied rigorously across all procurement channels. Currently, the Rule of Two is a regulatory procedure, not a statutory command. To preserve its power and intent amidst rapid change, Congress must pass H.R. 2804, the Protecting Small Business Competitions Act of 2025, to codify the Rule of Two into law. This action is not just prudent; it is an urgent necessity.
